Subject: Review comment # 7 regarding the plans conforming to the 2012 North Carolina
Energy Code.
Dear Joel:
This letter requests Catawba County to waive compliance with the 2012 North Carolina
Energy Code for the subject project.
For your review and file I have attached the memo we received from the state, through
Mecklenburg County, stating the Energy Code would be in force on June 1 (see highlighted
paragraph at bottom of page). We have talked to the state code officials who acknowledge
the confusion created by that December statement. However, even though the state
rescinded the statement a few days later, there was no follow up memo. We understand from
the state code officials that Catawba County Building Inspections has the power to make the
final decision regarding our project's energy code compliance.
We also believe we tried to identify all of the unknowns by meeting with your department twice
during the design process, well before the March 1 date.
We have a very disappointed client, since adding the roof insulation equates to about a $200K
cost increase. This is a design /build project, so costs are being managed throughout the
design process. This kind of cost increase could negatively impact the overall scope /program
of their operation reducing the number of jobs created.
Allowing our project (as designed) to comply with the 2009 North Carolina Energy Code would
be greatly appreciated and we respectfully request your decision to do so.
