In accordance with N. C. General Statute 130A-248(d), on October 3, 2011 your facility was billed for the annual $75.00 Food and Lodging fee.
This fee was for the fiscal year which ends June 30, 2012. When payment was not received within 45 days, a second invoice, which included a
$25.00 late payment fee, notice was mailed on November 17, 2011. The additional 15 days allowed by the law to pay the fee and the late fee
have now expired.
This is to notify you of intent to suspend the permit for this facility 30 days from date of receipt of this notice for nonpayment of annual fee and
the late fee was provided in N. C. General Statute 130A-248(d).
You have the right to a formal appeal of this decision by filing a petition for a contested case hearing with the Office of Administrative Hearings,
6714 Mail Service Center, Raleigh, N. C. 27699-6714. The petition must be received by the Office of Administrative Hearings within 30 days of
receipt of this notice. A petition form will be provided to you upon request from the Office of Administrative Hearings at the above address.
If you file a petition for a hearing, you must send a copy of the petition to the Office of General Counsel, 1601 Mail Service Center, Raleigh,
N. C. 27699-1601.
You may stop this action by submitting a check made payable to "DHHS" in the amount of $100.00 to:
