We will Begs by answering to this Complaint from the sale of 1055 Catawba
Greens Drive Newton, N.C. 2065& Van & Janet Dalton purchased this Home on
12-07- 2006. before closing the Dalads requested a Home Inspection, the Home
Inspector found a few minor things that we fined at that time. The Closing was
recorded In Catawba County on IW -2006. November-2007 the Dalton's contacted
as to do a pooch Wt before their One Year Warranty *spired.
We did mostly touch up caulking and peIntInL. At that time wort' thing was okay.
During the fast week of December 2007 we got a phone call from
Joel Herman Amt. Chat Building Impactor of Catawba County He told as of a
pboue call that He recdved from Janet Dakon making him to come out to 1055
Catawba Greens Drive Newton, N.C. 20651L The Dollon's showed bin a hair Mae
crack In the block foundation, during riot time Mr. Herman discovered some floor
girder intersections where not supported, be ask the Dalton's If they had contacted
no about fusing those, they amid they had not. When Mr. Herman looked at the
Inspection history he found a soft by the impactor that coadocted the floor framing
inspection about 141 girder sappora required by Final. At Final Inspection We was
mimed to be 6sed by the Catawba County Building Impactors and as. Mr. Herman
asks us to go under the boom with him to look at the Foundation and the girder.
He told the Dalton's that we had discussed re- grouting the crack in the block
founded= and diet disc was no structural problem with the Foundation, when he
told bar we where going to ft the girder's she related to Id us repair them at that
time. Mr. Herman told us diet he suggested to the Dalton's that a Structural
Esglneer look at the girder's for their satisfaction. We where Any with that, and
told Mr. Herman that we would pay for that, and they could choose one.
On December 18, 2007 Kelly Winkler of Chipman Engineers made an Inspection.
Mr. WInkler's report dated January 10, 2000 is attached In the complaint.
When we got the report dated January 10, 2008 we visited the Dalton's to look at
the l sum inside the home that was In the report. At that time we found that the
thermostat was set at 76 degrees, it was obvious to us dust the moisture that was left
inside the home had been removed from the astreme drought and the high
temperature, which bad to ends In the moWisp and Room, but Janet Dakota
Insisted that her Hone was 6dkng. We bras& our HVAC Contractor by the nest
day, he told her that we had just come through a serious drought and the recent

change from summer temperatures to cold n%bts, and having to turn beat on was
the cause of the normal cracks in the moldlap and floors, and that he seam put ■
humldifiar an the system to central the moisture in the home. The next contact was
a phone call from Armin Wagner the chief Bnfeding Inspector of Catawba County.
He wanted m to Wed him and the Dalton's at hit e111ce, we meet with Mr. Wanner
before the Dalsom's, be bad a copy of the Engimeers report dated January 1% 20Mt,
we reviewed the report wltk him and informed hum that the Engineers report dated
Jamomry 1% 2008 was Incorrect, he Hated In the report that there was throe sections
of the Boor joist that was over spas and where mot adequate and that No. 2 Grade
marks was all he could find sad that two section of floor joist where slxteas Inches
on center. We tom Mr. Wagerer that this was wrong. At that point Mr. Wapner asks
the Daltoa's to Join all of ML In mating with the Dalton's and Mr. Wagner we
discovered that oaks a portion of the fomadatiou cad floor bad been Inspected by the
Engineer, which M pages one through dgYt of the Engineer's report dated Jaarary
10, 2008. At that time the Dalton's requested a full foundation, floor and roof
analyse from Chipman Engineers, which is In the complaint Dated January 31,
2008.Once we got a copy of that report we where allowed to loped the floor
system, and feurd that the report wet not corral. At that time we called the
Engineer to make him aware and ask him to meet u so we could together ge in the
crow[ spa" sad prove to his his report was wrong. The Dalton's choose Kelly
Winkler of Chipman Engineer's. They where payed by as a sam of 83.129.00 for
reports that we had to prove to the eaglnar. We where waiting bb fiscal retort
which we received on May 23, 200& This report Is attached to this response.
we regret that the Dalton's repeatedly went behind our backs to try to get
satldlrction. To sum up, all the Eughmor could find was the girder intersections
needed to be supported, which has boo completed, and that we area's needed to
be re- grouted In the foundation, which has not bem done We have not abandoned
the project, we where Limply waiting for the goal Engineer's Report when we got
this complaint.
