General Stormwater Permit NCGO10000 - Condition Violations:
Part I, Section A, #2: The permittee shall implement the sediment and erosion control plan that has been
approved. Compliance with the approved plan is considered a condition of this general permit. Any
deviation from the approved plan shall be considered a violation unless prior approval has been obtained
from the approving authority.
Part I, Section B, #1: All erosion and sediment control facilities shall be inspected by or under the
direction of the permittee at least once every seven calendar days and within 24 hours after any storm
event greater than 0.5 inches of rain per 24 hour period. A rain gauge shall be maintained on the site
and a record of the rainfall amounts and dates shall be kept by the permittee. No rain gauge was
observed on site.
Part I, Section B, #2: The operator shall keep a record of all inspections as required by Section B, #I
noted above. These records shall be made available to DWQ upon request. No records were available
and no records storage area was observed at site.
Part I, Section C: During construction and until the completion of the project and the establishment of a
permanent ground cover, the permittee shall provide the operation and maintenance necessary to operate the
storm water controls at optimum efficiency.
This office requires that the violations, as detailed above, be abated immediately. If you have an explanation
for the noted violations that you wish to present, please respond in writing within thirty (30) days following the
receipt of this notice. Your explanation will be reviewed and if an enforcement action is still deemed appropriate,
your explanation will be forwarded to the Director with the enforcement package for his consideration. Please note
that these violations and any future violations are subject to civil penalty assessments of up to $25,000.00 per day for
each violation. If you have records, please submit a copy of your storm water records from the period beginning
June 1, 2008 to January 19, 2009 within 24 hours of receipt of this notice.
