The following are details that must be considered along with all other considerations. * Tanks shall be approved by DHHS, and certification supplied by the that must be considered along with all other considerations. * The installer shall be responsible to the owner for placement of the tanks and to insure that final grades are returned to the original natural grade, with exception of added structural features. * The supply trench shall be compacted to eliminate cavities left during initial fill placement. * Installation of the system shall be during dry conditions in order to protect the soil * All fittings shall be pressure rated fittings. * All joints shall be cleaned with PVC pipe cleaner and a heavy bodied glue applied to weld all joints. * Where required by the county health department, post installation inspections by the designer must be scheduled 5 week days in advance. Trenches shall be carefully excavated so the bottom is within 2"from the highest to the lowest points of elevation within the trench. If the bottom elevation needs adjusting after it has been * trenched, it will be done by removing high points rather than filling low points. It is extremely important to insure that trenches are not over excavated during initial trenching. All fine grading within the trench will be hand done with a shovel. No loose material will be left in the trench * All pipe openings in the tanks shall be properly grouted. This also applies to the joints around the riser. * All tanks shall be properly back filled and compacted to prevent slump at a later date. * Earth dams, constructed of relatively impervious material, shall be installed at the beginning and end of each lateral. * No heavy equipment shall be used on the field during or after installation. RECITALS WHEREAS,Grantor is the owner of that certain approximately 77.59 acre tract of property located in Catawba County,North Carolina,more particularly described on Exhibit A attached hereto and incorporated herein by reference(the"Denver Vaults"); WHEREAS, Grantee is the owner of that certain approximately 3.09 acre tract of property located in Catawba County,North Carolina,more particularly described on Exhibit B attached hereto and incorporated herein by reference(the"Renckens Property");and WHEREAS,Grantor intends to convey to Grantee rights and easements for the construction, use,and maintenance of a septic system across a 1.01 acre portion of the Denver Vaults Property, all as more particularly described herein. NOW, THEREFORE, in consideration of the agreements herein contained, Grantor and Grantee hereby agree as follows: 1. Construction of the Septic System.Subject to the terms hereof,Grantee hereby agrees, at Grantee's sole cost and expense,to construct septic system(s)(collectively,the"Septic System") serving the Renckens Property with facilities on both the Renckens Property and in the area within the Denver Vaults Property more particularly described as"Proposed Perpetual Septic Easement" on Exhibit C attached hereto and incorporated herein by reference (the "Septic Area"). To the extent that portions of the Septic Area are not adequate for Grantee's septic requirements,Grantor shall make available additional areas adjacent to the Septic Area as necessary to accommodate Grantee's septic requirements of two(2)five-bedroom homes,as subject to Grantor's approval. Accordingly,Grantor hereby grants to Grantee,its agents,successors and assigns,the temporary, non-exclusive right and easement(the"Temporary Construction Easement")over and upon the Denver Vaults Property for the sole purpose of accommodating Grantee's construction of the Septic System located on the Denver Vaults Property,which may include the installation ofpipes and other facilities and conducting grading within the Septic Area submitted electronically by "Knipp Law office, PLLC" in compliance with North Carolina statutes governing recordable documents and the terms of the submitter agreement with the Catawba County Register of Deeds. 3826-1178 Grantee shall obtain all necessary governmental permits and approvals for the construction of the Septic System,and shall perform(or cause to be performed)the construction of the Septic System in accordance with all applicable regulatory codes,rules, ordinances and guidelines, and in a good and workmanlike manner. The Temporary Construction Easement includes, but is not limited to,the right and privilege by Grantee,its contractors and agents,to ingress and egress onto the Denver Vaults Property with such vehicles, equipment,machinery,and construction supplies which are reasonably required in order to perform the construction of the Septic System in accordance herewith.Upon the completion of the Septic System,Grantee shall remove all vehicles, equipment,machinery,and construction supplies from the Denver Vaults Property and restore all areas of the Denver Vaults Property affected by the construction of the Septic System to a condition reasonably satisfactory to Grantor, at which time the Temporary Construction Easement shall automatically terminate and be of no further force and effort. Z Maintenance Easement.Upon completion of the Septic System in accordance with the foregoing,and thereafter during the effectiveness of this Agreement,Grantee, its successor and assigns,shall have the obligation of maintaining,repairing, and otherwise keeping the Septic System in clean,good and safe condition and state of repair in accordance with all applicable laws and regulations at its sole cost and expense,and Grantor hereby grants Grantee an easement for access,ingress and egress for operation,maintenance,monitoring,and repairs to the Septic System over the Denver Vaults Property for such purpose. 3. Sewage Discharge Easement. Subject to, and upon completion of,the Septic System in accordance with Paragraph 1 of this Agreement, Grantee shall have, and Grantor hereby conveys, establishes, and grants to Grantee and its heirs,successors and assigns,the exclusive right, privilege, and easement for the discharge of sewage in accordance with applicable laws and regulations over,across and through that portion of the Septic System located on the Denver Vaults Property. 4. Authority.Grantor and Grantee each hereby represent and warrant they have the right, power, and authority to enter into this Agreement and to grant the easements in accordance with the terms and conditions hereof.This Agreement,when executed and delivered by the parties hereto,will be a valid and binding obligation of the parties in accordance with its terms. 5. Binding Effect:Benefits and Burdens Running With Land.This Agreement shall be binding upon and inure to the benefit of the parties hereto,their employees,agents,and licensees, heirs, successors and/or assigns. The benefits and burdens,rights and obligations,easements and restrictions created by this Agreement shall be appurtenant to and run with and burden and be binding upon the lands described herein, and shall inure the benefit of and be binding upon the parties hereto and those claiming by,through,or under them.This easement granted shall be valid in perpetuity,without restriction to the number of septic systems as described in Paragraph 1 or in the event the Denver Vaults Property and/or the Renekens Property are subdivided into smaller parcels.The covenants,agreements,terms,provisions and conditions of this Agreement shall bind and benefit the successors in interest of the parties hereto with the same effect as if mentioned in each instance when a party hereto is named or referred to,it being understood and agreed that upon any transfer of ownership or all or part of any of the tracts, each such successor in interest shall 3826-1179 thereupon and thereafter assume,and perform and observe,any and all of the obligations of its predecessors in interest under this Agreement. 6. Severability. Should any provision hereof be declared invalid or unenforceable by legislative, administrative or judicial body, the other provisions hereof shall remain in full force and effect and shall be unaffected by same. 9 Amendment to Agreement.This Agreement may be amended only by a written agreement executed by each of the parties hereto and properly recorded in the Catawba CountyRegister. 10. Remedies for Breach. The tenors and conditions of this Agreement shall be enforceable by either of the parties hereto by actions for specific performance or injunction, in addition to any other remedies available at law. 11. No Waiver.No delay or omission by any party in exercising any right or power accruing upon any noncompliance or failure of performance by the other party under the provisions of this Agreement shall impair any such right or power or be construed to be a waiver thereof. 12.
