Our deeds (in file) only go back to 1976 (DB 1091-108/3-4-1976), which referred to Lot 14. DB 1551-758 reference a boundary description surveyed in 1988, and DB 1927-419 references a boundary description surveyed in 1989. Both of those descriptions, differ from the line shown as 525-46W 174.70 (on Plat 13-18).The boundary descriptions show that line as 525-53-42W 183.84.The deeds after that go back to referencing the lot in the S/D and not the boundary desc.There was a road closure (part in front of lot 14),which altered the how we show lot 14 on GIS, but that was just due to how it was drawn in. The request for a variance concerns a proposed water supply well on the referenced property that will serve a single-family dwelling and part of a structure on the property will be within twenty-five feet of the well. The home is on a lot with very difficult topography. Specifically, the variance request grants you permission to construct a water supply well at a distance closer than the twenty-five-foot setback to a building perimeter. Achieving the twenty-five-foot setback would be difficult given the challenges of the property. Based upon information provided by the Catawba County Health Department, and the property owner, it is my finding that based upon current conditions as the site exist today (as well as the current proposal for use of the structure) you meet the conditions necessary for approval of a variance as specified by 15A NCAC .0118 (a) (1) and (2).
