provisions of Chapter 150B for the above referenced permit(s)(which includes the IPs and ACs)in order for the authorized
agent/local health department to issue the applicable permit(new IP and/or AC)for the site. I understand by completing this form
that the permit(s)for a

I understand that the local health department's revocation of a permit can be appealed to the North Carolina Office of Administrative
Hearings within 30 days of the revocation pursuant to the North Carolina Administrative Procedure Act. I understand that in order for
the local health department to issue another IP and AC that the current IP and AC must be revoked. I understand that the local health
department's revocation of an IP or CA is not effective until 30 days from the revocation or,if the revocation is appealed,at the time
that the Office of Administrative Hearings issues a final decision. I understand that by signing this form and relinquishing my right to
appeal the permit revocation at the Office of Administrative Hearings that the local health department's permit revocation will become
effective immediately. I understand and agree that the revocation of a permit that takes effect immediately is in my best interest. I
understand that by signing this form that I agree that I do not want to appeal the permit revocation.
I understand that I am not required to relinquish my appeal rights but that this is an option available to me so I do not have to wait 30
days for the revocation of the permit to ke effect.

Dear Mr Little:
The Environmental Health Division of Catawba County Public Health intends to revoke your
Improvement Permit and Authorization to Construct 30 days from the date of this notice.
If the permits are revoked, you must apply for a new Improvement Permit and Authorization to
Construct (AC)and meet the requirements of the current laws and rules necessary to obtain a new AC.
You have a right to an informal review of this decision.You may request an informal review by the
environmental health supervisor at the local health department.You may also request an informal
review by the NC Department of Health and Human Services Regional Soil Scientist.A request for
informal review must be made in writing to the local health department.
You also have a right to a formal appeal of this decision. To pursue a formal appeal, you must file a
petition for a contested case hearing with the Office of Administrative Hearings 1711 New Hope Rd,
Raleigh, NC 27609. You may write the Office of Administrative Hearings, call the office at (984) 236-
1850 or get a copy of the petition form from the OAH web site at http://www.oah.nc.gov . The petition
for a contested case hearing must be filed in accordance with the provision of North Carolina General
Statutes 130A-24 and 1508-23 and all other applicable provisions of Chapter 150B. North Carolina
General Statute 130A-335 (g) provides that your hearing would be held in the county where your
property is located.

THIS MODIFICATION OF DRAIN FIELD EASEMENT, made as of the /9 day of August,
2022,by and between Margaret Pemmaraju and husband,Sriram Pemmaraju("Grantor")and
Charles G. Little, Jr. (aka Charles J. Little,Jr.)and wife Donna M. Little("Grantee").
WITNESSETH
WHEREAS, Grantor is the owner of a parcel of property commonly known as 3555 Mt.
Beulah Rd., Sherrills Ford,NC 28673(Tax Parcel No. 368702970751 /REID: 803829),and being
all that property conveyed to Grantor by Deed recorded in Book 3580, Page 957 (the "Gram
PrQperty");
WHEREAS, Grantee is the owner of a parcel of property commonly known as 5945 Little
Pkwy. Sherrills Ford,NC 28673(Tax Parcel No. 368702877808/REID: 80393),and being all that
property conveyed to Grantee by Deed recorded in Book 3730, Page 216(the"Grantee Property");
WHEREAS, The Grantor Property is subject to that Drain Field Easement, which is
appurtenant to the Grantee Property,recorded in Book 3125,Page 1852 and more particularly shown
Submitted electronically by "Regent Law"
in compliance with North Carolina statutes governing recordable documents
and the terms of the submitter agreement with the Catawba County Register of Deeds.

on Plat Book 71, Page 142 (the "Existing Drain Field Easement"); and
WHEREAS, Grantee has requested, and Grantor has agreed to modify, amend and
supplement the Existing Drain Field Easement as set forth herein.
NOW THEREFORE,the Grantor,for and in consideration of the premises and other valuable
considerations,the receipt of which is hereby acknowledged,Grantor and Grantee do hereby amend
and modify the Existing Drain Field Easement as follows:
1. Location of the Easement. The Existing Drain Field Easement location is hereby
amended as shown on that plat for Charles G. Little Jr. and Donna M. Little, prepared by J. Dean
Slate, PLS, and being more particularly described as follows:
COMMENCING at a point in the southern margin of Little Parkway (Existing 45' Private Access
Easement"),said point marking a common corner of that tract now or formerly owned by Charles G.
Little,Jr. and wife, Donna M. Little(Deed Book 3730,Page 216)to the West and that tract now or
formerly owned by Margaret Pemmaraju(Deed Book 3580,Page 957)to the South,thence South 46
degrees 45 minutes 14 seconds West 70.64 feet to an existing iron; said iron being the point of
BEGINNING for the subject drain field easement;
Thence, from said BEGINNING point:
South 40 degrees 59 minutes 59 seconds East 78.06 feet to an iron;
Thence, South 59 degrees 31 minutes 27 seconds West 20.56 feet to an iron;
Thence, South 6 degrees 46 minutes 00 seconds West 23.36 feet to an iron;
Thence, South 72 degrees 52 minutes 41 seconds West 21.64 feet to an iron;
Thence,North 21 degrees 48 minutes 24 seconds West 88.94 feet to an iron in the eastern line of
Little;
Thence, along the eastern line of Little three (3) courses and distances as follows:
1. North 55 degrees 44 minutes 23 seconds East 7.34 feet;
2. North 55 degrees 44 minutes 23 seconds East 17.17 feet;
3. North 46 degrees 45 minutes 14 seconds East 3.72 feet to an iron; which is the point of
BEGINNING,containing both the existing easement and additional easement as shown on that plat
for Charles G.Little Jr.and Donna M.Little,prepared by J.Dean Slate,PLS,dated August 10,2022,
a copy of which is attached hereto as Exhibit A.
2. Except as modified herein,the terms of the Existing Drain Field Easement is hereby
ratified, reaffirmed, and incorporated by reference herein.
