EASEMENT FOR SEPTIC DRAIN FIELD
CATAWBA COUNTY
THIS EASEMENT FOR A SEPTIC DRAIN FIELD entered on this 6th day of June
2022, by and between:
Hank Leslie Guess and wife,Tarnera Y. Guess, hereinafter referred to as"Grantors",and
Austin Heck and wife, Rachel Heck, hereinafter referred to as "Grantees".
WHEREAS, Grantors are the owners of all of Tract 1 as shown on that plat recorded in
Plat Book 75 at Page 55,Catawba County Registry;
WHEREAS, Grantees are the owners of all of Tract 2 as shown on that plat recorded in •
Plat Book 75 at Page 55, Catawba County Registry;
WHEREAS, Grantors and Grantees desire to establish a Easement for a Septic Drain Field
upon a portion of said Tract 1 for the benefit of Grantees personally;
WITNESSETH:
NOW, THEREFORE, Grantors in consideration of the mutual promises and other valuable
consideration paid by the Grantees, the receipt of which is hereby acknowledged, does by these
presents grant, bargain, sell and convey to Grantees personally an exclusive right and easement
over and upon the below described portion of the aforementioned Tract 1 for use as a Septic
Drain Field for said Tract 2, together with all rights to construct and maintain upon said Tract 1
submitted electronically by "The Williams Firm, PLLC"
in compliance with North Carolina statutes governing recordable documents
and the terms of the submitter agreement with the Catawba county Register of Deeds.

underground drainage lines extending from said Tract 2 onto and across the below described
portion of said Tract 1 for a sanitary drain field and repair area, and to go upon said Tract 1
whenever the same is reasonably necessary for the purpose of inspecting, maintaining and
repairing the drainage lines, drain field and repair area with the portion of said Tract 1 subject
to said easement being described as follows:
BEGINNING at a set 0.04' rebar set at the edge of the right of way for Mountain View Road (SR
1192) and said point of beginning being the southeast corner of said Tract 1; thence running
with the common boundary line of said Tract 2, N 38° 58' 56" W 146.11 feet to a set 0.04'
rebar; thence N 49° 19' 35" E 68.36 feet; thence S 38° 58' 56" E 101.00 feet to a point; thence S
16° 21' 04" W 84.00 feet to the POINT AND PLACE OF BEGINNING.
FURTHERMORE, it is understood and agreed that Grantees shall be responsible for all
construction, maintenance and repairs of the improvements they place upon said Tract 1 in
furtherance of the Septic Drain Field and that Grantees shall keep Tract 1 in a sanitary
condition, including but not limited to, maintaining the Septic Drain Field in such a way that it
shall not emit any nauseous smells nor cause the land to become unusable for other purposes;
the Grantors shall unilaterally have the authority to make determinations as to whether the
Grantees are maintaining Tract 1 in a sanitary condition. Also, Grantees shall solely be
responsible for repairing said Tract 1 to its current condition post-construction of the Septic
Drain Field.
IN TESTIMONY WHEREOF, the Grantors and Grantees have hereunto set their hands and seals
