NC 16 HWY, Conover, NC 28613 PIN# 3755 -01 -07 -3929 Property Address: 6519 Alice Lane, Conover, NC 28613 Township: Date Complaint Received: 3/11/10 Name of Complainant: Tracy Caldwell Details of Complaint: Septic failing. It is running down hill and across highway 16. Date of First Inspection: 3/15/10 Sanitarian: Megen McBride Inspection Report: On March 15, 2010 I made the initial inspection and the septic system was failing. I subsequently mailed the owner, Billy Little, a Notice of Violation. After receiving the NOV, Mr. Little applied for a septic repair permit. After the property lines were surveyed, I made multiple trips to the site, once with Mike Cash for a second opinion. The repair permit was issued May 3, 2010. On May 13, 2010 Mr. Little called me and stated that he had a plumber fix some leaks and the sewage had dried up. I then made a site visit to confirm that the area was indeed dry. Throughout the following months I made several more site visits and the septic system remained in compliance with no signs of sewage outbreaks. Since the system had remained in compliance for several months, I was nearing the point of "closing" the complaint when out office received a phone call from a tenant that the system had begun to fail. On October 1, 2010 I made a site visit and the system was indeed failing again. I called and spoke to Billy Little. He stated that he was aware that there was again a problem and was arranging with a septic contractor to have it repaired. At least 2 weeks have passed and I have neither heard from Billy Little or any septic contractor regarding the installation of the repair system. HICKORY On November 10, 2010 I met Billy Little on site. He has made several positive site alterations in an attempt to alleviate the failure. He has brought in some fill material for the end of the drainfield; he has diverted all gutter drains; he has built a small burm up slope of the system to divert surface water. All these modifications look good and the system is not currently failing. I explained to Billy Little that the system must remain in compliance and I will checking back periodically. Spoke to Mike; we will hold off on pursuing this legally to see if his modifications permanently solve the failure. On December 10, 2010 I checked the site and the system was not failing. On January 31, 2011 I checked the site and the system had begun to fail again. Will send second NOV. On March 4, 2011 I checked the system; still failing. The NOV deadline has expired. Will send to legal. Supervisor Assessment: I personally visited the site on March 8, 2011, and verified that sewage effluent is surfacing at the end of the drainlines and running down to Hwy 16. The owner has attempted to address plumbing issues which, initially, seemed to have corrected the problem, but have since proven unsuccessful. Please proceed with legal action as appropriate. Your wastewater system is not in compliance. On 2/1/11, an inspection of the wastewater system by the Catawba County Public Health Department indicated the following violations: Violation Law or Rule Cite Sewage surfacing 15A NCAC 18A.1961 (a)(1)(A) You are hereby ordered to bring your wastewater system into compliance by completing the following: ❑ Install/Repair wastewater system. You must obtain ® Other (Spec) a Repair Permit from the local health department Install permit # AUTH -5 -10 -6840 prior to repairing your system ❑ Eliminate wastewater discharge and connect to an ❑ Perform Maintenance (Specify) approved wastewater system If the wastewater violation is not brought into compliance by 2/16/11, appropriate legal action will be taken. Failure to comply with the laws, rules and this notice will subject you to the following legal remedies; Injunction Relief [G.S. 130A -18], Administrative Penalties [G.S. 130- 22(c)], Suspension or Revocation of Permits [G.S. 130 -23], and Criminal Penalties [G.S. 130 -25].
