Dear Mr. Rose:
I am writing in response to Mr. Scott Garand's September 15, 2009 letter and to the revised drawings for the referenced project
dated September 9, 2009 (received September 18, 2009). Mr. Garand's letter and the revised drawings provide an acceptable
response to the comments in the DHSR review letter of July 30, 2009.
House Bill 1297 now exempts hospital outpatient services from being licensed when they are provided in buildings that are
located more than thirty feet from hospital facility and that are designated as Business Occupancy under NFPA 101. Because
of this new law, your fitness center is no longer required to be licensed, and therefore is not required to be reviewed by this
office. Since the architectural portion of the drawings was in the process of being reviewed before this law was ratified, we
have completed the review. However, we will not perform an engineering review and we do not need to receive an additional
response nor will we inspect the completed facility. When construction of the project is completed, please provide a copy of
the Certificate of Occupancy issued by Catawba County Building Inspections so that we may close-out our files.
Please use our Project No. HL-8328-JURG on all correspondence related to this project. If you have any questions or if we
can be of any further service please let us know.

This letter is to inform you that based off the letter Catawba Valley Medical Center
received from the North Carolina Department of Health Service Regulation (DHSR)
dated October 5th, 2009 referencing North Carolina House Bill 1927 (exemption for
hospital outpatient services from being licensed and reviewed by DHSR that are business
occupancy and located more than 30 feet from the hospital facility) that FreemanWhite,
Inc. will no longer be designing areas of refuge in the CVMC Fitness Center as part of
the Fitness Center Locker Room Renovation Project.
